1. Agreement to Terms

This website ("Site") is owned and operated by Apex Trails ("Apex Trails," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "client") and Apex Trails, governing your use of our Site and the booking of our guided hiking expeditions (collectively, the "Service"). By using our Site or booking an expedition with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our separate Liability Waiver.

2. Our Service and Scope of Work

Apex Trails provides professionally guided mountain hiking and trekking expeditions. The specific scope of services, detailed itinerary, inclusions, and exclusions for each expedition will be outlined on the tour page and in your formal Booking Confirmation. These Terms provide a general framework for our professional relationship. We reserve the right to refuse service to anyone if we deem them unprepared or a safety risk to themselves or the group.

3. Assumption of Risk

You acknowledge that mountaineering, hiking, and trekking are inherently dangerous activities. Risks include, but are not limited to, falls, rockfall, adverse weather conditions, altitude sickness, equipment failure, and encounters with wildlife. By booking a trip with us, you voluntarily accept all risks, both known and unknown, associated with these activities. You must sign our separate Liability Waiver and Release form as a condition of joining any Apex Trails expedition.

4. Booking and Payments

To engage our services, clients are required to complete a booking form and provide a non-refundable deposit. This deposit secures your spot on the selected expedition date. The full payment schedule will be explicitly outlined in your Booking Confirmation. You agree to provide current, complete, and accurate medical and personal information required for the safe execution of the trip and to promptly update us if your condition changes.

5. Third-Party Services

As part of our logistical arrangements, we coordinate with various third-party service providers (e.g., local transport, mountain huts, hotels). While we select reputable partners, we act as an agent in these interactions. Your contractual relationship is ultimately with each individual provider. Apex Trails is not liable for any loss, damage, or injury arising from the actions, omissions, or failure to perform by any third-party service provider.

6. Cancellation Policy

Our cancellation policy is detailed on our website and in your Booking Confirmation. Due to the extensive logistical planning and non-recoverable costs associated with expeditions (such as permits and guide assignments), all deposits are non-refundable. Cancellations must be submitted in writing. We strongly recommend that all clients purchase comprehensive travel insurance that includes trip cancellation coverage.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APEX TRAILS, ITS DIRECTORS, GUIDES, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS, INJURY, OR DEATH RESULTING FROM THE INHERENT RISKS OF MOUNTAIN TRAVEL OR THE ACTIONS OF ANY THIRD PARTY. Our total liability in connection with any claim arising from our Service shall not exceed the total fees paid by you to Apex Trails for that specific expedition.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any legal action arising under these Terms will be brought exclusively in the federal or state courts located in Denver, Colorado.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will update the "Last Updated" date at the top of this page. Your continued use of our Service after revisions become effective constitutes your acceptance of the new terms.
